Dispute resolution

Any dispute arising out of or relating to these Terms or ClinicMedix shall be resolved through good faith negotiations between the parties. If the dispute cannot be resolved through negotiations, it shall be resolved through binding arbitration conducted in Kenya, in accordance with the rules of the Chartered Institute of Arbitrators, Kenya Branch. The decision of the arbitrator shall be final and binding on the parties.

Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms shall remain in full force and effect.

Waiver

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition, and any failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

Entire agreement

These Terms constitute the entire agreement between you and ClinicMedix regarding your use of ClinicMedix and supersede all prior or contemporaneous understandings and agreements, whether written or oral, regarding such subject matter.
